I am in favor of the application. This is an established retail business which is what we need to support in our neighborhood.

I would also point out that the rules provide for this process, it is part of the rules, and going through the conditional use process is following the rules as they are established in the IDO. It doesn’t mean that it will be approved, but there is a process built in to ask for this.

 

I am not a customer of Duke City Herbs but would point out that this seems to be exactly the kind of situation that the Cannabis Conditional Use provision is designed to address. I would hate to see them have to move to a different location to serve their clientele.

Thank you for this information, While we fully understand the parameters we don't intend to violate them but would like to apply the conditional licensing permits (these are meant for special situations). Please keep in mind that I have already established my herb business here before the parameters were set.  In respect to the local objections, we will not be advertising in Nob Hill  as a "cannibus dispensary" , rather we intend to cater to the needs of our preexisting clientele in an attempt to continue to serve our Hollistic community.  Thank you for your concern as we commit to expanding our business.

You might not realize that your leadership often uses these responses like surveys with which they respond to the City.

 

This is not a criticism of these types of businesses but multiple cannabis and alcohol licenses will all have serious impacts on how the district/corridor is perceived by visitors and potential developers and will affect the kinds of visitors that dominate our district.

You have enormous power – please use it well.

The Board of the NHNA will soon be reviewing a request for a conditional use to allow for cannabis retail within 600ft of another cannabis retail location. Because cannabis retail has only recently been legalized by the state, the NHNA has not heard neighbors' opinions on this topic and does not have a policy for cases like these. We would like neighborhood input. In particular, we would like to understand the neighborhood's views on the density of cannabis retail locations along Central, from Girard to Washington.

 

Here are some details about this case and the process.

 

From the ZHE, the details of the request are:

VA-2022-00155 Project# PR-2019- 002179 Jana Quintero requests a conditional use to allow for cannabis retail within 600 ft of another cannabis retail location for Lot 6, Block 8, Mesa Grande Addn, located at 4012 Central Ave SE, zoned MX-M [Section 14-16-4- 3(D)(35)(c)]

 

A facilitated meeting with the applicant was held on July 18th, and the meeting report is attached. As part of the meeting, the NHNA proposed the applicant could have an open house so people could understand the business. The applicant has responded by offering a shop tour on August 5th.

 

As a reminder, the NHNA has no legal authority to approve or deny a conditional use; that is the role of the Zoning Hearing Examiner (ZHE). However, the NHNA does provide input on all ZHE requests that fall within the NHNA's boundaries. 

 

The applicant will present their request at the regular meeting of the NHNA Board of Directors on August 10th.
