Neighbors, stay informed and be safe. Listed below are links to issues regarding public safety and recreational cannabis, and why I am opposed to the conditional use. Dispensaries that are in close proximity to one another in an over saturated market have a propensity to attract more crime to an area.  With ART in place, drivers zoom through residential streets, and there are still the countless horrific accidents on Lead/Coal.  A combination of several drinking establishments in an area and cannabis presents huge safety issues.  In October, 2021, a drugged driver lost control of his vehicle which jumped the curve and ended up in my front yard hitting a tree.  If anyone had been out walking, they would have been seriously injured or killed. ·        Since recreational marijuana was legalized, traffic deaths in which drivers tested positive for marijuana increased 109 percent while all Colorado traffic deaths increased 31 percent.

·        Since recreational marijuana was legalized, traffic deaths involving drivers who tested positive for marijuana more than doubled from 55 in 2013 to 115 people killed in 2018.

·        This equates to one person killed every 3 days in 2018 compared to one person killed every 6½ days in 2013.

·        Since recreational marijuana was legalized, the percentage of all Colorado traffic deaths that were marijuana-related increased from 15 percent in 2013 to 23 percent in 2018.

Larimer County Sheriff Justin Smith said since Colorado decriminalized marijuana, Fort Collins has become a magnet for transients.  “A large percent of those come to us with serious criminal histories,” Sheriff Smith said. “It's very typical to hear from them, ‘You know what? We came here for the marijuana.”   Sheriff Smith said 1/3 of the county jail’s inmates are homeless transients.  “We saw an increase in jail population up until this year, every year by just about 50 inmates,” he said.

Neighbors,

The Board of the NHNA will soon be reviewing a request for a conditional use to allow for cannabis retail within 600ft of another cannabis retail location. Because cannabis retail has only recently been legalized by the state, the NHNA has not heard neighbors' opinions on this topic and does not have a policy for cases like these. We would like neighborhood input. In particular, we would like to understand the neighborhood's views on the density of cannabis retail locations along Central, from Girard to Washington.

Here are some details about this case and the process.

From the ZHE, the details of the request are:
VA-2022-00155 Project# PR-2019- 002179 Jana Quintero requests a conditional use to allow for cannabis retail within 600 ft of another cannabis retail location for Lot 6, Block 8, Mesa Grande Addn, located at 4012 Central Ave SE, zoned MX-M [Section 14-16-4- 3(D)(35)(c)]

A facilitated meeting with the applicant was held on July 18th, and the meeting report is attached. As part of the meeting, the NHNA proposed the applicant could have an open house so people could understand the business. The applicant has responded by offering a shop tour on August 5th.

As a reminder, the NHNA has no legal authority to approve or deny a conditional use; that is the role of the Zoning Hearing Examiner (ZHE). However, the NHNA does provide input on all ZHE requests that fall within the NHNA's boundaries. 

The applicant will present their request at the regular meeting of the NHNA Board of Directors on August 10th.
