Bob, according to DSIRE, it's something that you have to do proactively. So
I would have to take my neighbor to the south through some administrative
proceeding that would mark some sort of easement on their property before
they added a second story that would block my solar access. If you wanted
to do that with the city, start by filing a solar right declaration in
bernalillo county against the city and see what happens. You do have to
have a 'solar collector' installed (evidence of your improvement). There is
a strange prior appropriation definition that may protect a structure or
building that already blocks the solar access, prior to you wanting to
assert your solar access right. I don't think that applies to trees though.

It also states that absent a local ordinance ( I doubt ABQ has come up with
one) someone can block your solar access by a tree as long as the shading
is only 10 percent of the daily sunlight.
